A VISIT TO THE BORDER AREA
On 21 November 2004 an SRP delegation led by Sam Rainsy
visited the commune of Cham, district of Kompong Trabek, province of
Prey Veng
in order to assess the situation along the border with Vietnam |

on Cambodian territory
in 1987. After its completion the canal was annexed by Vietnam.

SRP MPs to Train with IRI
|
|
Opposition MPs are to train with the
International Republican Institute (IRI) from this coming Monday as
part of a new on-going program to strengthen the Party leadership,
according to SRP and IRI officials.
“The training on Monday is a beginning of a new
rigorous program that has been designed to develop the capability of
the SRP Parliamentarians,” Opposition spokesman Ung Bun-Ang said.

Mr. Yet Chariya, Deputy
Prosecutor at the Phnom Penh Municipal Court, has
responded to Sam Rainsy’s November 3 letter
(made public at yesterday’s SRP press
conference) by inviting the Opposition leader to meet with him on
November 5, at 8:00 am, at the Court. They will
discuss the defamation lawsuit filed by
Prince Norodom Ranariddh. To see

My name is Sam Rainsy. I am a
member of Cambodia’s National Assembly. This is the second time that I appeal to
the solidarity of parliamentarians throughout the world. I made my first appeal
in 1995, hoping at that time to be able to prevent my expulsion from the
National Assembly. I had been first expelled from my party, which is one of
Cambodia’s ruling parties, but subsequently I was also expelled from the
National Assembly because I was the only parliamentarian who dared criticize the
Government.

Je suis député à l’Assemblée nationale du Cambodge. C’est la
deuxième fois que je suis amené à lancer un appel pour solliciter
la solidarité de mes collègues parlementaires à travers le monde.
La première fois, c’était en 1995. J’espérais alors pouvoir
empêcher mon expulsion de l’Assemblée nationale. J’avais d’abord
été expulsé de mon parti qui est associé au pouvoir, puis mon
mandat parlementaire m’a été aussi enlevé parce que j’étais le
seul député à oser critiquer le gouvernement.

jour où nous commémorons le treizième anniversaire de la signature
des Accords de Paris sur le Cambodge le 23 octobre 1991. Ces
Accords signés par dix-huit Etats ont conduit à la première
opération de maintien de la paix de grande
envergure menée par les Nations Unies, et ont ouvert une
nouvelle page de l’histoire du Cambodge et celle
des relations internationales. Les droits de la personne humaine
et la démocratie en sont sortis renforcés,
jetant ainsi les bases d’un développement équitable et

Election Observers: For a Better Registration Outcome
The SRP Parliamentarians share some NGO’s
concern that the October 2004 voter registration process has
basically faltered. A group of experienced election observers –
Comfrel, Nicfec, Youth Council of Cambodia, and other NGOs –
jointly claim that the registration has not been as effective as
it could have been. The National Election Committee (NEC) could
manage to register, as at 18 October 2004, only 29 percent of
unregistered eligible voters.

|
|
The SRP
Parliamentarians are rather amused to read a newspaper report (Rasmei
Kampuchea, October 16) that some sixty MPs of the ruling parties
are filing lawsuits against Opposition leader Sam Rainsy for
providing “false information” to former King Norodom Sihanouk.
Some high-profile MPs argued the letter had led to the King’s
retirement. And, it has been a rumour that the charge the
Opposition leader has now to answer for could be that his letter
has severe implications on the national security.

strongly condemn a fresh violent act committed against its members
in Kampong Cham.
On the
night of October 03, 2004 at 8:00 pm, a group of unidentified men
tossed a grenade into the house of Mr. Sam Phat
40, an SRP active member in Tuol Prek Village, Mean
Commune, Prey Chhor District, Kampong Cham Province. Sam Phat and
his two children got injured from this grenade

|

the Khmer Rouge trial, which is one of the most worthwhile causes
it can embark upon. It is crucial the cost of the trial not be an
excuse to deny the Cambodian people justice any longer. If
necessary, the UN must set aside its policy that requires an
upfront cash for two years of funding before the trial can
commence.

the logistics, or the lack of it, for the upcoming voter
registration process from 1 to 18 October. At this late stage,
besides some public briefing a few weeks ago by the National

is deafening. It is not very likely that the process will

intitulé « Le roi juge sévèrement les choix de Sam
Rainsy » paru dans Cambodge
Soir du 8 septembre 2004 peut soulever des questions auprès
de vos lecteurs qui ne sont pas au courant de la teneur des
entretiens que j’ai eus avec Sa Majesté le Roi à Pyongyang
et à Pékin en juin et août derniers.
Question : Pourquoi le PSR a-t-il « refusé de suivre le Funcinpec, qui
fut pourtant son allié durant presque un an, dans la
constitution d’un gouvernement de coalition avec le PPC » ?
Réponse : Le
Funcinpec et le PSR avaient formé, au lendemain des élections
de juillet 2003, l’Alliance des démocrates pour faire
contrepoids au PPC et, pour cela, ils s’étaient engagés à
lutter toujours ensemble – soit à l’intérieur du
gouvernement, soit au sein d’une Grande opposition – sur la
base de principes démocratiques, pour mieux défendre les intérêts
de la nation.

FAÇADE DEMOCRATIQUE PRESENTE DES LEZARDES DE PLUS EN PLUS
PROFONDES
|
|
Je me permets de vous
soumettre ci-dessous, à l’attention des lecteurs de Cambodge Soir,
une réflexion sur l’évolution récente de la situation politique au
Cambodge que l’on pourrait intituler « Dérive totalitaire ».
Depuis les élections
organisées par les Nations unies et le rétablissement de la
monarchie en 1993, le Cambodge peut se
prévaloir d’une façade démocratique. Mais
cette façade présente des lézardes de plus en plus profondes
montrant l’intérieur d’un régime qui est le
dévoiement d’une tentative de
démocratisation authentique. Deux facteurs sont à l’origine de ce
dévoiement: d’une part, le scrutin de liste
instituant la représentation proportionnelle
intégrale (sans combinaison avec le
scrutin majoritaire pour un nombre de
circonscriptions électorales) aboutit à une
domination des partis sur la vie politique
au détriment des idées et des initiatives citoyennes d’origine
individuelle ou associative; d’autre part,
l’absence de démocratie interne dans des
partis politiques d’origine communiste ou de type princier
conduit à la concentration de tous les
pouvoirs d’Etat entre les mains d’une personne ou
d’un petit clan d’associés agissant au nom des
deux partis politiques constituant la «
majorité parlementaire ».

activist perished due to the acts of violence. After Chhim Kok, 55,
SRP active member who was killed in front of his house in Koh Kong
province, another SRP activist Mrs. Soeun Ho, 37, who lives in Atsu
village, Sambo commune, Prasat Sambo district, Kampong Thom province

organizing an armed insurgency designed to topple the
government. The Prime Minister’s highly inflammatory remarks are

Opposition Will Not Give In, or Give Up
The SRP Members of Parliament note with
disappointment that their expectation has actually materialised; the
very first thing the illegitimate government has embarked upon is to
squash the Opposition. The ruling parties’ priority now is to break
the SRP with carrots and sticks, as if they do not have urgent matters
of national interests to attend to – like poverty reduction.
At least
five SRP Members of Parliament, namely Ahmad Yahya, Cheam Channy,
Kieng Vang, Ngo Sovann, Yim Sovann, and senator Chao Phally have been
offered positions in the new government – some are accompanied with
threats of negative repercussions if refused – as if it is not yet
huge enough to sink a Titanic. The threat delivered to one of them has
come true. After his decline, SRP Parliamentarian Chheam Channy was
duly implicated in what Prime Minister Hun Sen yesterday referred to
as a revolt plan of the Opposition party, involving recruits for rebel
forces. The SRP categorically denies such baseless allegations.

NEW GOVERNMENT IS ILLEGITIMATE AND MUST BE CONDEMNED
The SRP Members of National Assembly denounce the
unconstitutional formation today of an illegal government, and call
upon all those who are committed to the rule of law and democratic
principles, especially donor countries, to make it clear to the coup
leaders in Phnom Penh that their government will not be acceptable.
The new
government has failed to gain legitimacy, integrity, and dignity and
therefore cannot represent the Cambodian people since it was formed
following a violation of the Constitution and by using threat and
intimidation against Members of Parliament. The Acting Head of State,
Samdech Chea Sim, who is also the ruling party president, was purged
and sent into temporary exile for refusing to conspire in the illegal
scheme to suspend relevant Articles of the Constitution. In effect,
there has been a two-step coup against the State and the ruling
Cambodian People’s Party.

SAMDECH CHEA SIM MUST BE FREE TO ACT
I
would like to make an urgent appeal to the international community,
especially friends of Cambodia who uphold democracy and human rights,
to condemn in no uncertain terms the threat
and intimidation targeted at Samdech Chea
Sim, the Acting Head of State of Cambodia. According to reliable
sources, his residence has been surrounded
by armed police force since 2:00 am this
morning. His fate remains unknown.
Samdech Chea Sim has been under tremendous pressure within his party,
the ruling Cambodian People’s Party (CPP),
to promulgate in the King’s absence the
controversial legislation, “Addition to the Constitution". Even His
Majesty King Norodom Sihanouk has explicitly
questioned the legitimacy of the legislation
passed in the National Assembly on 8 July 2004 and in the Senate
on 12 July 2004; and he refused to sign the
promulgation. The King has, instead, asked
Senate President Chea Sim, his representative in the country,
to act in accordance to his conscience in this
grave matter, and has suggested that a
popular referendum be organized.

History
will remember that today, 8 July 2004, the Cambodian People’s Party under
the compulsion of Mr Hun Sen and Funcinpec led by Prince Norodom Ranariddh
agreed to suspend the Constitution of the Kingdom of Cambodia, in
particular the provisions concerning the procedures for a functioning
National Assembly (Article 82) and the formation of the Royal Government
(Article 119). The suspension of the Constitution – through an
unconstitutional “addition to the Constitution” supposedly adopted this
morning – signifies nothing other than a constitutional coup. This coup is
by and large directed towards His Majesty the King; through a violation of
the Constitution, it seeks to exclude the King from the process of forming
the new government.

Consensus Show-of-Hands
Makes Package Vote Unnecessary
The SRP Members of Parliament are very much concerned with the pending
severe violation of the Constitution through the proposed “package vote”,
which is effectively driven by mistrust within the CPP and Funcinpec. The
SRP has put forward to leaders of the two parties a suggestion that can
avoid the unconstitutional package vote.
A formula to deal with the mistrust is to legally allow a show-of-hands
voting procedure under exceptional circumstances, which would ensure –
without the package vote – an election of the new National Assembly
leadership and a vote of confidence for the government. The formula is
based on a single amendment to Clause 40 of the National Assembly Internal
Rules to allow for the show-of-hands vote. Clause 40 currently stipulates
that secret ballot is mandatory for a vote of confidence and sanction.

Victory for Democracy
The Alliance of Democrats welcomes the signing of the
30 June 2004 Protocol of Cooperation Agreement between Funcinpec Party and
the Cambodian People’s Party, which will complete the basis for the
formation of a new and legal government after a political impasse of
eleven months. It is, indeed, a victory for democracy in Cambodia.
First,
the peaceful settlement shows no one is able to govern the country
illegitimately and indefinitely. Second, the Alliance has succeeded in
generating unprecedented debates on issues of national importance prior to
the formation of a new government. Third, the Alliance has developed into
a formidable political force, offering the Cambodian people a viable

COMMEMORATING THE SEVENTH ANNIVERSARY OF THE MARCH 30, 1997 GRENADE ATTACK
The Sam Rainsy Party would like to inform the Public and the Press that
in order to pay respects to the victims, a ceremony commemorating the 7th Anniversary of the March 30, 1997 grenade attack in Phnom Penh will
be held at 8:30am on March 30, 2004 at the Stupa erected in the park across from the National Assembly.
